Corona laws are constantly being adjusted – even in supermarkets like Aldi, Liddle and Ray. The 2G Retail Act is now being discussed.

Frankfurt – Keep your distance and wear a mask: The current corona measures in supermarkets are currently in effect. But is it soon possible that consumers will soon be able to shop without a face mask? In the case of 2G law, this would be possible. So far, it can only be used nationwide in selected public spaces. Can supermarkets be a part of it soon?

This is already a hesitant reality: instead of relying on tightening, the state is introducing more relief in Corona. One of them is the 2G retail option.

Aldi, Lidl, Rewe & Co .: Is the 2G option coming for retailers and supermarkets?

On Tuesday (October 12, 2021), after consulting with the Corona Cabinet, Chinese Prime Minister Walker Bufier announced the controversial innovation: All companies should be allowed to choose whether they just want to allow vaccination and recovery to enter their business. This means that it will soon no longer be necessary to pay attention to distances and to meet the requirement of the mask on the spot – even in supermarkets and beverages. However, other rules now apply to supermarket shopping.

According to the press release of the inciting state chancellor, the optional 2G regulation was created “at the request of the industry”. The media wrote that the 2G option can only be used on a daily basis: “We assume that this option will only be used on a daily basis and that everyday businesses will not use it.”

However, for the finished supermarkets, this Corona law means that it is possible to decide separately whether the supermarket management insists on a 2G regulation – or not. This is what the Administrative Court in Frankfurt decided. The introduction of the 2G Regulation into retail has already been evident in a judgment of the Administrative Court of September 2021. At that time, a seller of barbecue accessories sued against the prohibition on operating an office in accordance with the standards of the 2G Regulation. Meanwhile, the state of North Rhine-Westphalia (NRW) has also taken a stand regarding a possible 2G regulation in supermarkets. *

As the daily newspaper Welt reports, the German Trade Union welcomes the ruling. Merchants will have the free choice “whether they want to apply a 2G regulation or not,” notes Trade Union Director Stephen Ghent. However, he does not expect the law to be held nationwide, according to the report. Instead, it depends on the location and will be used only in the case of a high number of corona cases.

Corona Laws in the Supermarket: What Threats to People Are Not Immunized if the 2G Option Comes?

The innovation is controversial. According to the Robert Koch Institute, 65.3 percent of the total population is currently fully vaccinated (as of October 12, 2021). If supermarkets like Aldi, Liddle, Adka or Rio use the 2G option, about 35% of the population in Germany would no longer be able to shop at the big supermarket chains.

However, the likelihood of this occurring is highly unlikely. To date, supermarkets have not been considered a high-risk pollution area during the epidemic. This is shown, for example, by a study by the Technical University of Berlin. Although closed rooms are considered a risk area for corona virus aerosol transmission, the risk in supermarkets, for example, is significantly lower than in offices – logically depending on occupancy. In addition, there is an assessment by the Federal Office of Risk Assessment, which states that there is currently no known risk of corona contamination through food.

In addition, supermarkets and discounters are part of the basic offering: if the 2G rule is applied, a large number of potential customers will be included in the categories. However, it is still possible that the 2G rule will be used in individual industries.
